The Law Office of Joshua L. Harmon specializes in providing services for people who are interested in filing Chapter 7 or Chapter 13 bankruptcy in Nevada or Arizona. There are many reasons that finally bring people to the decision to file Bankruptcy:
» Medical Bills
» Judgments
» Wage Garnishments
» Credit Card Debt
» Mortgage Debt
» Stop Foreclosure
A Chapter 7 Bankruptcy is the liquidation of all your debts without the necessity of having to make payments on a monthly basis. Your case is filed and completed in approximately 90-120 days. Chapter 7 is filed when there is no money leftover to pay creditors such as your credit cards each month. You may file for Chapter 7 bankruptcy every eight years, measured from the date of the earlier bankruptcy filing. For example, if you filed on August 1, 2000, you will not be able to file again until August 2, 2008.
Under The Bankruptcy Reform and Consumer Protection Act of 2005-what we will simply refer to it as the “new law”, you must pass the “means test” in order to qualify for Chapter 7 bankruptcy. Failure to pass this test may result in the need to file Chapter 13 Bankruptcy. Chapter 13 Bankruptcy is commonly entitled Adjustment of Debts of an Individual With Regular Income. Chapter 13 Bankruptcy will result in a repayment plan for 3-5 years, wherein you make payments to the Bankruptcy Trustee. Upon completion of the 3-5 years or repayments, all of the debts being surrendered will be discharged. To learn more about the difference between Chapter 7 and Chapter 13 please visit the Bankruptcy section of our website. You will also find a list of items that may qualify as exemptions in Bankruptcy.
